China finally announced its final version of the RoHS directive, the “Administration measures on the Control of Pollution Caused by Electronic Information Products” by Ministry of Information Industry (MII). The first in-force date for China RoHS is March 1, 2007. In the meantime 1st of January was discussed, but China postponed it again.
The scope of the final law has been modestly modified. “Software products” are not any longer included, and toys and home appliances will not fall under the scope of the law. But still the scope is uncertain in many other areas and will need further clarification.
According to MII, China will take a two-step approach. Step one, self-declaration of hazardous substances and “safety period”; step two, hazardous substances are restricted to use in the products covered in the caralogue.
The catalogue, specifying products to comply with material restrictions, will be relieved later this year, according to China NCB, China Quality Certification Center (CQC) with which SGS keeps a close contention.
As of March 1, 2007, all products sold in China or imported into China must comply with the new regulations. It comes to this, and that is the most important fact, that if distributors import non-conforming products into China before the deadline, retailers will not be allowed to sell those products after March 1, 2007. Due to this, the Chinese law requires that all products, from dock to retail shelf, have to be compliant as of March 1, 2007.
